COBALT successfully represents clients in a dispute with OCMA regarding the issue of permanent residence permits

COBALT successfully represented two clients (natural persons) in the administrative proceedings before the institution by appealing the decision of the Office of Citizenship and Migration Affairs (OCMA) on the refusal to issue residence permits in Latvia to the clients due to non-compliance with the provisions of the Immigration Law.
The situations of both COBALT clients were characterized as unusual cases which the legislator had not foreseen when adopting the relevant regulation, as a result of which the OCMA was obliged to make proportionality considerations and apply consequences that would be adequate, proportionate and fair.
By the decision of the head of the OCMA, both unfavourable decisions were revoked and COBALT clients were granted permanent residence permits.
