COBALT successfully represented a client in the Supreme Court (administrative case no. 3-21-125)

We successfully represented a client in a legal dispute with the municipality of Viimsi, concerning the planning of a commercial building in the buffer area of the municipality’s green network, which is not permitted by the current general plan and thematic plan.

The decision of the Administrative Board of the Supreme Court states for the first time the objectives of the buffer zone of the green network. The Supreme Court also reiterates a standpoint, according to which the effectiveness of the green network designed with higher-level planning must not be jeopardized by changing the network at the level of detailed planning.

The decision of the Supreme Court will also be important for the courts in the future in the matter of the acceptance, evaluation and inclusion of documentary evidence in the file by the court in a written procedure.
