COBALT has successfully represented a client – an Italian citizen who lives in Latvia – before the Grand Chamber of the Court of Justice of the European Union in relation to accessibility of state financed medical care to an economically inactive national of a Member State residing legally in the territory of another Member State.
On 15 July 2021 the Grand Chamber of the Court of Justice of the European Union delivered a judgment in Case C-535/19 A, intervening parties: Ministry of Health of the Republic of Latvia, and found that national legislation, which excludes economically inactive Union citizens, who are nationals of another Member State and who exercise their freedom of movement and their rights to reside in the host Member State from the right to be affiliated to the public medical insurance scheme of the host Member State, is contrary to EU law.
The representation of the client before the Grand Chamber of the Court of Justice of the European Union was ensured by COBALT team, led by Managing Partner Lauris Liepa and including Associate Dr. Toms Krūmiņš and Junior Associate Maira Pužule.
