COBALT successfully represented an international custom software development company Helmes in a public procurement dispute

COBALT successfully represented Helmes, an international custom software development company in disputes regarding the public procurement Development and Maintenance Services for Collection App Software organised by the Information Technology Centre of the Ministry of Finance. The object of this public procurement is the new collection app of Statistics Estonia which is a universal system used for all statistical and ordered assignments with regard to private individuals as well as to business entities. The implementation of the system will facilitate the acceleration of the data collection process and raising its effectiveness, as well as to the improvement of the data quality and decrease of the cognitive administrative load.

Helmes was declared the successful bidder in this public procurement, and the results were disputed by two competing bidders – OÜ Aktors and AS CGI Eesti. The challenge concerned the compliance of the bid as well as its evaluation, and mainly the duty of care of the bidders upon submission of documents and their opportunity to explain or rectify the information set out in the documents. The disputes were resolved for the benefit of our client and Helmes will be able to enter into the frame agreement with the expected value of MEUR 1.25.
