COBALT data protection and tax practice groups have issued the latest newsletter on a recent development.
On 23 July 2018, the State Revenue Service (“SRS”) provided an explanation regarding how the GDPR “right to be forgotten” is to be applied in light of the existing legal requirements to store certain types of data in compliance with accounting purposes and to fulfil the requirements of tax laws. The SRS states that the “right to be forgotten” shall not apply during the time period that the law requires data controllers to store certain types of documents, even if these documents contain personal data.
