The Supreme Court of Latvia explains the rights of apartment owners to make decisions through a survey

COBALT successfully represented clients in the Senate of the Supreme Court – on June 15, 2021, the Department of Civil Cases issued a significant judgment in the context of the restrictions caused by the pandemic, which explains the rights of apartment owners to make a decision without a face-to-face meetings.

The case was initiated regarding the annulment of the decision of the community of apartment owners adopted on the basis of a questionnaire, because in the opinion of the plaintiff violations have been committed in the decision-making process. Ten co-owners filed a cassation appeal of the community of apartment owners. The Senate agreed with the arguments of the cassators formulated by COBALT, referring the case to the appellate court for reconsideration.
